1. Introduction and Acceptance
By booking, paying for or attending any session at Studio Per Noi, or by using pernoi.ca, you agree to these Terms of Service. If you do not agree, please do not use our services or website.
In these Terms, “Per Noi”, “we”, “us” and “our” mean Studio Per Noi, located at 1-3927 Edmonton Trail NE, Calgary, Alberta. “You” and “client” mean anyone who uses our website, books a consultation or receives services at the studio.
These Terms apply together with any intake form, waiver, program agreement or practitioner consent form you sign with us. If those documents conflict with these Terms, the more specific document applies to that service.
2. Our Services
Per Noi offers two kinds of service at the studio:
- Strength & Conditioning Coaching: personal training programs designed and delivered by our coach to build strength, improve conditioning and support long-term health and performance.
- Chiropractic care: assessment and treatment by Dr. Jaclyn Gardiner, a licensed chiropractor, including manual therapy, soft tissue therapy, acupuncture, cupping, rehabilitation exercise, prenatal, postnatal and paediatric care.
We offer a complimentary consultation for coaching so you and the coach can decide whether the program fits your goals. A consultation does not create any obligation to purchase.
Coaching programs are individualized. The program, session format, frequency and price are agreed with you at or after your consultation. Results depend on many factors, including your effort, consistency, nutrition, sleep and health, and are not guaranteed.
3. Health Screening and Your Responsibilities
Before your first session you must complete our health intake questionnaire (such as the PAR-Q+ or equivalent) honestly and completely. You agree to tell us right away about any change to your health, medications, injuries or pregnancy status.
We may require written clearance from your physician before you start or continue training. We may also modify, pause or decline a program if we believe it is unsafe for you.
You are responsible for:
- Training within your limits and telling your coach immediately if you feel pain, dizziness, shortness of breath or any other discomfort
- Following the coach’s instructions on technique, loading and equipment use
- Arriving rested, hydrated and in suitable athletic clothing and clean indoor footwear
Coaching is not medical care. Our coach does not diagnose or treat medical conditions. Nutrition and lifestyle guidance is general in nature and does not replace advice from your doctor or a registered dietitian.
4. Booking and Scheduling
Coaching consultations and sessions are booked by contacting us at (403) 617-7738 or info@pernoi.ca, or through the contact page on pernoi.ca. Chiropractic appointments are booked through Dr. Gardiner’s online booking system or by calling (403) 807-3331.
Studio hours are Monday to Saturday, 8:00 AM to 11:00 AM and 3:00 PM to 8:00 PM. Hours may change for holidays or other reasons, and we will post changes on our website or social media where possible.
A session is confirmed only once we confirm it with you. Sessions start and end at the scheduled time. If we must cancel or reschedule a session, we will give you as much notice as we can and offer a new time or a session credit at no cost to you.
5. Fees, Payment and Packages
Coaching prices vary by program and are confirmed with you before you commit. All prices are in Canadian dollars and GST is added where applicable.
- Payment timing: single sessions are paid at or before the session; packages and monthly programs are paid in full before the first session of that package or month, unless we agree otherwise in writing.
- Accepted methods: debit and credit card.
- Recurring billing: if you choose a monthly program, you authorize us to charge your chosen payment method each billing period until you cancel with 30 days’ written notice.
- Price changes: we may change prices with at least 30 days’ notice. Packages you have already paid for keep their original price.
- Late payment: we may pause sessions until an overdue balance is paid.
Chiropractic fees are set and billed by Dr. Gardiner’s practice. Direct billing is available for most insurance companies, but you remain responsible for any amount your insurer does not cover.
6. Cancellations, Late Arrivals and No-Shows
Your session time is reserved for you alone, so we ask for at least 24 hours’ notice to cancel or reschedule.
| Situation | Coaching policy |
|---|---|
| Cancelled 24+ hours before | No charge; rescheduled or credited |
| Cancelled under 24 hours before | Full session fee charged, or one session deducted from your package |
| No-show | Full session fee charged, or one session deducted from your package |
| Late arrival | Session ends at its scheduled time; full fee applies |
| Coach cancels | No charge; rescheduled or credited |
We may waive a late-cancellation fee for a genuine emergency or illness, at our discretion. Please do not attend if you have symptoms of a contagious illness; let us know and we will work with you on rescheduling.
Chiropractic appointments follow the cancellation policy of Dr. Gardiner’s practice, shown when you book.
7. Refunds and Transfers
Payments for sessions, packages and programs are non-refundable once services begin, except as set out below or required by law.
- Medical reasons: if a doctor confirms in writing that you can no longer train, we will refund unused sessions in your package on a pro-rated basis, or freeze your package until you are cleared.
- If we cannot deliver: if Per Noi cannot provide the sessions you paid for, we will refund the unused portion.
- Transfers: with our approval, unused package sessions may be transferred to another person, who must complete our intake forms first.
- Monthly programs: cancelling ends future billing; the current paid period is not refunded.
Refunds are issued to the original payment method within 14 days of approval.
8. Chiropractic Care
Chiropractic services at the studio are provided by Dr. Jaclyn Gardiner, an independent chiropractor regulated by the College of Chiropractors of Alberta. Dr. Gardiner is responsible for her own clinical decisions, patient records and billing.
- Informed consent: before treatment, Dr. Gardiner will explain the proposed care, its benefits, risks and alternatives, and ask for your consent. You may withdraw consent at any time.
- Not emergency care: chiropractic and coaching services are not a substitute for emergency medical care. In an emergency, call 911.
- Minors: a parent or legal guardian must consent to, and should attend, treatment of a patient under 18.
- Coordination of care: with your written consent, Dr. Gardiner and our coach may share relevant information so your training supports your treatment.
Any complaint about chiropractic care may be raised directly with Dr. Gardiner or with the College of Chiropractors of Alberta.
9. Studio Conduct and Safety
Per Noi is a private studio. To keep it safe and welcoming, you agree to:
- Use equipment only as instructed, and only during your session unless we approve otherwise
- Return weights and equipment to their place and wipe down equipment after use
- Treat coaches, practitioners and other clients with respect; harassment, discrimination or abusive behaviour is not tolerated
- Not attend under the influence of alcohol, cannabis or other impairing substances
- Supervise any children you bring; children may not use equipment unless they are enrolled
- Tell us right away about any injury, accident or damaged equipment
We are not responsible for lost, stolen or damaged personal belongings. You are responsible for damage to studio property caused by misuse or negligence.
We may refuse service, or end a client relationship, if these rules are broken. If we end the relationship for reasons other than misconduct, we will refund any unused prepaid sessions.
10. Assumption of Risk and Release of Liability
Strength and conditioning training involves physical exertion and inherent risks. These include muscle strains, sprains, joint injuries, falls, injury from dropped or moving equipment, and, rarely, cardiac events or death.
By participating, you confirm that you understand these risks and voluntarily accept them. To the fullest extent permitted by Alberta law, you release Per Noi, its owners, coaches, staff and contractors from claims for injury, loss or damage arising from your participation, except where caused by our gross negligence or wilful misconduct.
This section summarizes the separate Release of Liability, Waiver and Assumption of Risk form that every client must sign before their first session. The signed form governs if it differs from this summary.
11. Privacy, Photos and Testimonials
We collect personal information such as your name, contact details, health history, goals and progress measurements so we can deliver safe, effective coaching. We handle it in line with Alberta’s Personal Information Protection Act (PIPA) and our Privacy Policy.
- We use your information only to provide and administer our services, contact you about your sessions, and meet legal obligations.
- We do not sell your information. We share it only with your consent, with service providers who help us run the business (such as booking or payment systems), or where required by law.
- You may ask to see or correct the personal information we hold about you by emailing info@pernoi.ca.
Chiropractic health records are collected and kept by Dr. Gardiner’s practice under the privacy rules that apply to her profession.
We will not post photos, videos or progress results that identify you on our website or social media without your written consent. Testimonials are published only with your permission, and you may ask us to remove yours at any time.
12. Website Use and Intellectual Property

Training programs, workout plans and materials we create for you are for your personal use only and may not be shared or sold.

13. Liability, Governing Law and Contact
Limitation of liability. To the fullest extent permitted by law, Per Noi’s total liability for any claim relating to our services or website is limited to the amount you paid us in the 3 months before the claim arose. We are not liable for indirect or consequential losses. Nothing in these Terms limits rights you have under Alberta consumer protection law that cannot be waived.
Indemnity. You agree to cover Per Noi’s reasonable costs from claims caused by your breach of these Terms, your misuse of equipment, or your deliberate misconduct.
Governing law. These Terms are governed by the laws of Alberta and the federal laws of Canada that apply there. Any dispute will be resolved in the courts of Alberta, sitting in Calgary.
Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
Changes. We may update these Terms from time to time. The current version will be posted on pernoi.ca with its effective date. Continued use of our services after a change means you accept the updated Terms.
